The words of which the initial letter is capitalized have meanings defined under the following conditions.

  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Sirius Technology Advanced Research, LLC and its affiliates and subsidiaries.  For the purpose of the GDPR, the Company is the Data Controller.  For the purpose of the CCPA, the Company is the legal entity that collects Consumers’ Personal Data and determines the purposes and means of the processing of Consumers’ Personal Data, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ personal information.
  • Application means the software program provided by the Company downloaded by You on any electronic device, named CE5 Contact.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Account means a unique account created for You to access our Service or parts of our Service.
  • Service refers to use of the Application or when You visit the website https://siriusdisclosure.com/ or any other website owned or operated by Us.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.  For the purpose of the GDPR, Service Providers are considered Data Processors.
  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
  • Facebook Fan Page is a public profile named Dr. Steven Greer specifically created by the Company on the Facebook social network, accessible from https://www.facebook.com/doctorstevengreer/
  • Personal Data is any information that relates to an identified or identifiable individual.  For the purposes for GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.  For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with You or your household except (i) publicly available information from government records, (ii) deidentified or aggregated Consumer information, and (iii) information specifically excluded by the CCPA.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Data Controller, for the purposes of the GDPR, refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
  • Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
  • Consumer, for the purpose of the CCPA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in California for other than a temporary or transitory purpose, and (2) every individual who is domiciled in California who is outside California for a temporary or transitory purpose.
  • Sale, for the purpose of the CCPA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s Personal Data to another business or a third party for monetary or other valuable consideration.
  • GDPR means, as may be amended from time to time, Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).  Any Services and terms of this Privacy Policy subject to the GDPR only apply to Data Subjects
  • CCPA means, as may be amended from time to time, the California Consumer Privacy Act of 2018 (Cal. Civ. Code §§ 1798.100 to 1798.199) and any related regulations or guidance provided by the California Attorney General.  Any Services and terms of this Privacy Policy subject to the CCPA only apply to Consumers.

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Usage Data is collected automatically when using the Service.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain Your data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Business Transactions

ANALYTICS

We may use third-party Service Providers to monitor certain Personal Data and analyze the use of our Service.

  • Google Analytics: a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of Our Service. Legal Basis for Processing Personal Data under GDPR

We may process Personal Data under the following conditions:

FACEBOOK FAN PAGE

Data Controller for the Facebook Fan Page

The Company is the Data Controller of Your Personal Data collected while using the Service. As operator of the Facebook Fan Page (https://www.facebook.com/doctorstevengreer/), the Company and the operator of the social network Facebook are Joint Controllers.

Facebook Insights

We use the Facebook Insights function in connection with the operation of the Facebook Fan Page and on the basis of the GDPR, in order to obtain anonymized statistical data about Our Users.

For this purpose, Facebook places a Cookie on the device of the User visiting Our Facebook Fan Page. Each Cookie contains a unique identifier code and remains active for a period of two years, except when it is deleted before the end of this period.

Facebook receives, records and processes the information stored in the Cookie, especially when the User visits the Facebook services, services that are provided by other members of the Facebook Fan Page and services by other companies that use Facebook services.

Exercising Your CCPA Data Protection Rights

In order to exercise any of Your rights under the CCPA, and if you are a California Consumer, You can submit a verifiable consumer request via the methods listed at the bottom of this Privacy Policy.  Only You, or someone legally authorized to act on Your behalf, may make a verifiable consumer request related to Your Personal Data.  You may also make a verifiable consumer request on behalf of Your minor child as discussed below.  The verifiable consumer request must (a) provide sufficient information that allows Us to reasonably verify You are the person about whom we collected Personal Data or an authorized representative and (b) describe Your request with sufficient detail that allows Us to properly understand, evaluate, and respond to it.  You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

The Company will disclose and deliver the required information free of charge within 45 days of receiving Your verifiable consumer request. The time period to provide the required information may be extended once by an additional 45 days when reasonable necessary and with prior notice.

We do not sell Personal Data. However, Service Providers we may choose to partner with (for example, advertising partners) may use technology on the Service that “sells” Personal Data as defined by the CCPA law.

“DO NOT TRACK” POLICY AS REQUIRED BY CALIFORNIA ONLINE PRIVACY PROTECTION ACT (CALOPPA)

Our Service does not respond to Do Not Track signals. However, some third party websites do keep track of Your browsing activities. If You are visiting such websites, You can set Your preferences in Your web browser to inform websites that You do not want to be tracked. You can enable or disable DNT by visiting the preferences or settings page of Your web browser.

CHILDREN’S PRIVACY

The Service may contain content appropriate for children under the age of 13. As a parent, you should know that through the Service children under the age of 13 may participate in activities that involve the collection or use of Personal Data. We use reasonable efforts to ensure that before we collect any Personal Data from a child, the child’s parent receives notice of and consents to our Personal Data collection practices.

We also may limit how We collect, use, and store some of the information of Users between 13 and 18 years old. In some cases, this means We will be unable to provide certain functionality of the Service to these Users. Information Collected from Children Under the Age of 13

The Company may collect and store persistent identifiers such as cookies or IP addresses from children without parental consent for the purpose of supporting the internal operation of the Service.

We may collect and store other Personal Data about children if this information is submitted by a child with prior parent consent or by the parent or guardian of the child.
